- Eligible YAP Offenses
Eligible YAP Offenses
The following offenses are eligible for participation in a Youth Aid Panel:
Any Summary Offense, including local ordinance
Misdemeanor Offenses that include:
- Simple Assault, 18 Pa. C.S.A. §2701 (only graded as an M3)
- Cyber Harassment of a Child, 18 Pa. C.S.A. §2709(a.1)
- Criminal Mischief, 18 Pa. C.S.A. §3304
- Injuring or Tampering with Fire Apparatus, Hydrants, Etc., 18 Pa. C.S.A. §3305 (only if there was no fire)
- Institutional Vandalism, 18 Pa. C.S.A. §3307
- Agricultural Vandalism, 18 Pa. C.S.A. §3309
- Defiant Trespass, 18 Pa. C.S.A. §3503(b)
- Agricultural Trespass, 18 Pa. C.S.A. §3503(b.2)
- Theft of Property Lost, Mislaid or Delivered by Mistake, 18 Pa. C.S.A. §3924
- Retail Theft, 18 Pa. C.S.A. §3929
- Theft from Motor Vehicle, 18 Pa. C.S.A. §3934
- Failure of Disorderly Persons to Disperse Upon Official Order, 18 Pa. C.S.A. §5502
- Disorderly Conduct, 18 Pa. C.S.A. §5503
- False Reports to Law Enforcement Authorities, 18 Pa. C.S.A. §4906 (unless another individual is arrested based on the report)
- False ID to Law Enforcement Authorities, 18 Pa. C.S.A. §4914
- Small Amount of Marijuana, 35 P.S. §780-113(a)(31)
- Drug Paraphernalia, 35 P.S. §780-113(a)(32) (for marijuana only)
- Accidents Involving Damage to Unattended Vehicle or Property, 75 Pa. C.S.A. §3743
- Conspiracy to any eligible offense
Certain offenses require YAP pre-approval, including:
- Any felony offense
- Any offense where restitution is greater than $500
- False Alarms to Agencies of Public Safety, 18 Pa. C.S.A. §4905
- Hazing (graded as a misdemeanor), 18 Pa. C.S.A. §2802
- Any case where a victim is not in agreement with Youth Aid Panel disposition
In addition to having a qualifying offense(s), the juvenile should meet the following criteria:
- Admit to the offense
- Have no prior involvement with District Court or Juvenile Court
- Have no significant school disciplinary issues
- Have not previously participated in a Youth Aid Panel
- Regardless of eligibility, no youth shall be referred to the Youth Aid Panel without the agreement of the arresting police department
